In 2022, our client suffered a mental health event while at an airport. While in the security line, the client manifested behavior that caused Transportation Security Administration (“TSA”) and local police officers to respond. The encounter quickly escalated into a physical altercation, which resulted in our client being arrested. We were retained within 24 hours and investigated information family members provided that led us to conclude a mental health issue might be present. After contacting prosecutors and working with a great team of mental health professionals, we presented our findings to the Office of the State Attorney, who dismissed the charges.
The client was able to present the same information to a TSA official, who decided that it would be inappropriate to fine our client. We accomplished this during a multi-defendant, multi-week federal jury trial. The criminal justice system is not designed to help those suffering from mental health problems, and we were privileged to help this young man get a second chance. It could not have been done without perseverance and working with the right professionals.
