Federal and State Agency Investigations

At the Law Offices of Horwitz & Citro, P.A., our team of dedicated criminal defense attorneys and civil litigators can stand toe-to-toe with governmental agencies and attorneys without flinching. We regularly represent clients in high-stakes criminal matters as well as civil or administrative actions from white-collar criminal proceedings to regulatory compliance investigations.

In our practice, we regularly encounter attorneys and agents from the following agencies and offices:

  • The U.S. Securities and Exchange Commission (SEC): The Enforcement Division of the SEC deals with investigating violations under the federal Securities Exchange Act of 1934, such as insider trading and securities fraud. The SEC operates through its headquarters in Washington, D.C. with SEC regional offices located in Atlanta, Denver Miami, Salt Lake, Boston, Ft. Worth, New York, San Francisco, Chicago, Los Angeles, and Pittsburgh. SEC investigations involve looking into fraud and violations of complex securities laws. It is common for the DOJ and FBI to conduct criminal investigations covering the same conduct. The result is that the SEC will bring a civil case to recover money and injunctions to prevent further fraud and bar defendants from the securities industry. The DOJ and FBI, with the benefit of cooperation with the SEC, will also bring criminal charges which carry long prison sentences and forfeiture of assets.
  • The Federal Trade Commission (FTC): The FTC and its agents are tasked with enforcing federal consumer protection laws involving fraud, deception, and unfair business practices under the Federal Trade Commission Act, Identity Theft Act, the Clayton Act, and other federal laws. Like the SEC, the FTC conducts civil investigations and often works with the DOJ and FBI. This cooperation often results in the FTC bringing a civil case and the DOJ bringing a criminal prosecution involving the same conduct.
  • The Office of the Inspector General (OIG): Federal agencies conduct investigations in their areas of responsibility through the Offices of the Inspector General. For example, the Department of Defense, NASA and the FAA (to name a few) have an OIG with criminal investigators. Investigations by OIG agents can be conducted with other federal investigators such as FBI Special Agents. Criminal investigations and prosecutions can result from an OIG investigation.
  • The Florida Office of the Attorney General (AG): Florida, like every state, has an Attorney General. The AG’s office can conduct investigations which may be civil and may lead to criminal investigations in conjunction with state criminal prosecutors and investigators.

When you are confronted by state or federal investigators, whether OIG, SEC, State AG’s, or FTC, do not be fooled into thinking that the matter is only civil. These groups coordinate the DOJ and FBI. Investigations which appear to be civil are often joint investigations with criminal investigators that lead to civil and criminal cases.
