The tax payer is entitled to a jury trial in District Court, however, no jury is provided in the Court of Federal Claims or Tax Court. The tax payer must pay the tax before seeking a refund when pursuing the matter in District Court and the Court of Federal Claims. In Tax Court, the tax payer does not need to pay the tax prior to suing the Commissioner of IRS. IRS legal counsel represents the Commissioner in these cases.
